Approval of the Transportation Regional Incentive Program Agreement and corresponding Resolution (Exhibit D) with the Florida Department of Transportation (FDOT) for the construction of the Advanced Traffic Management System/Intelligent Transportation System (ATMS/ITS) on I-175/I-375/Bayshore Drive Downtown St. Petersburg Project.

 

                     Agreement is for FDOT financial assistance for $1,531,860 for future construction of the ATMS/ITS System on I-175/I-375/Bayshore Drive Downtown St. Petersburg project.

                     Final system will provide regional operation of the transportation network and support the ITS related activities including transit, freeway management, operations and emergency services on daily and catastrophic basis.

                     Pinellas County local funding is from the from Ninth Cent Local Option Fuel Tax in the amount of $4,938,406.00 (76.3%). State grant funding is from the Transportation Regional Incentive program in the amount of $1,531,860.00 (23.7%).

                     The Fiscal Year 2023 Budget shows the grant amount as $3,050,000; this will need to be revised during the Fiscal Year 2024 budget process to provide sufficient funding.

                     Total construction cost estimate: $6,470,266.00.

                     The agreement term is through June 24, 2026.

 

FDOT FPN: 436678 1 54 01 in the amount of $1,531,860 for County PID: 002599A ATMS/ITS Downtown St Petersburg; for a term expiring June 24, 2026; Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

Summary:

Summary

The Agreement provides 23.7% of the construction funding required for the installation of ATMS/Intelligent Transportation System (ITS) on the I-175/I-375/Bayshore Drive Downtown St. Petersburg project in the amount of $1,531,860.00.  Work for this ATMS project includes installation of 25 new closed-circuit television (CCTV) cameras, nine (9) dynamic message signs (DMS), fiber optic cable, and conduit throughout the downtown area of St. Petersburg. The project will provide a new communication hub via the St. Petersburg Police Department station, which will further improve the County’s ITS network.

The TRIP Agreement duration is from the date of full execution to June 24, 2026.
Section 14(a) of this Agreement requires the County to indemnify and hold harmless FDOT to the extent permitted by law as limited by and pursuant to the provisions of Section 768.28, Florida Statutes. County Resolution No. 06-70 prohibits the County from indemnifying others under most circumstances. At the request of the County, FDOT has agreed to modify their boilerplate indemnification language through the Amendment. Staff and the County Attorney agree that the FDOT indemnification requirement is within an acceptable level of risk.

Background Information:

The project is part of an overall implementation of the Countywide ATMS/ITS effort that was adopted and funded by the Board utilizing the Ninth Cent Local Option Fuel Tax (LOFT) in 2006. The project will include, fiber optic communication, dynamic message signs and closed-circuit television cameras.

 

Fiscal Impact:

Funding is budgeted within the Capital Improvement Program: Transportation Function, Advanced Traffic Management System Program, 002599A ATMS St Pete Downtown.

 

LOFT: $4,938,406.00 (76.3%)

TRIP: $1,531,860.00 (23.7%)

 

Total Construction Cost: $6,470,266.00

 

The current budget shows the grant amount as $3,050,000; this will need to be adjusted. Project 002599A does not have sufficient budget and will need to be revised during the FY24 budget process.
