Recommended Action

Approval and execution by the County Administrator of the Third Amendment to the Capital Project Funding Agreement (Funding Agreement) with the Florida Holocaust Museum, Inc. (Museum) for a three-month extension to the project completion timeline.

 

                     Third Amendment extends the project completion date by three months from March 31, 2025, to June 30, 2025.

                     Funding Agreement is for $350,000.00 and supports a new lobby entrance that will address security concerns, ADA access and a separate entrance for school groups.

                     Museum requested an extension due to delays brought on by the recent hurricanes.

                     Payment will be made on a reimbursement basis upon project completion.

                     This project is included in the Convention and Visitors Bureau Fiscal Year 2025 budget and will be paid from the Tourist Development Tax Fund.

The Museum is requesting approval to extend the project completion date in the Funding Agreement by three months from March 31, 2025, to June 30, 2025. This request is due to delays brought on by the recent hurricanes.

Background Information:

The Capital Project Funding Agreement with the Museum was approved by the Board of County Commissioners (Board) on June 2, 2020, for $350,000.

On January 13, 2021, the Board approved the First Amendment extending the project commencement date to no later than April 20, 2022. This extension was requested by the Museum due to delays brought on by Covid-19.

On April 12, 2022, the Board approved the Second Amendment extending the project commencement date to no later than April 30, 2024, and the completion date to no later than March 31, 2025. This request was due to continued delays from Covid-19. In the same action, the Board also granted a waiver of the Capital Project Funding Program Guidelines (Guidelines) since the project completion date had moved beyond the Guideline requirement which states, “Capital Project completion timelines may not exceed three years from execution of the [Capital Project] funding award agreement…”.

On March 18, 2025, the Convention and Visitors Bureau (CVB) received a new request from the Museum to further extend the project completion date by three months from March 31, 2025, to June 30, 2025. The request for a Third Amendment is due to delays the Museum is experiencing from the recent hurricanes. 

The Museum will be paid the funding award on a reimbursement basis at project completion.

 

Fiscal Impact:

This action in itself has no fiscal impact.

 

Funding to support the Capital Project Funding Program is provided through the Tourist Development Tax Fund.
