Approval of the Second Amendment to the Capital Project Funding Agreement with the Florida Holocaust Museum, Inc. (Museum) for an extension to the project timeline, which requires a waiver of the Capital Project Funding Program Guidelines (Guidelines) as to section III.E.

 

                     Second Amendment extends project commencement date by two years to no later than April 30, 2024, and completion date to no later than March 31, 2025.

                     This Amendment requires a waiver of the Guidelines since it extends the project completion beyond three years from the agreement execution date of June 2, 2020.

                     Museum requested the extension due to the continuation of delays brought on by COVID-19.

                     Capital Funding Agreement is for $350,000.00 and supports a new lobby entrance that will address security concerns, ADA access and a separate entrance for school groups.

                     Payments through the Capital Project Funding Program are made on a reimbursement basis at project completion.

At the Museum’s request, staff is asking the Board of County Commissioners (Board) to approve a two (2) year extension to the Museum’s Capital Project Funding Agreement project timeline. This extension will require the Board to review and approve a waiver of the Guidelines as to section III.E, which requires a project’s completion date to be within three (3) years from the execution date of the funding agreement, which in the case of the Museum, was June 2, 2020.

The First Amendment to the agreement with the Museum extended the project start date to no later than April 20, 2022, and completion date to no later than April 30, 2023.

Background Information:

The Capital Project Funding Agreement with the Museum was approved by the Board on June 2, 2020, for $350,000.00. On December 11, 2020, staff received a request from the Museum to extend the project timeline due to delays brought on by COVID-19. Subsequently, the First Amendment was approved by the Board on January 13, 2021. The First Amendment extended the project commencement to no later than April 20, 2022, and the completion date to no later than April 30, 2023.

On January 24, 2022, staff received a second request from the Museum to extend the project timeline by two (2) years. According to the Museum, they continue to experience project delays due to COVID-19. The Second Amendment that is now before the Board will extend the project commencement date to occur no later than April 30, 2024, and the completion date to no later than March 31, 2025. Since the completion date extends beyond the three (3) year limitation set forth in section III.E. of the Guidelines, the Amendment will require the Board to waive the Guidelines as to that section.

Funding to support the Capital Project Funding Program is provided through the Tourist Development Tax Fund. Appropriation for the agreement with the Museum is included in the Fiscal Year 23 Budget request.
