Approval of the Interlocal Agreement between Pinellas County and the National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) Co-Permittees for Water Quality Monitoring and Assessment program.
• This agreement is necessary for the County and NPDES MS4 co-permittees to continue to implement the program and cost-share the state-required Water Quality Monitoring and Assessment Program through December 31, 2025.
• County and twenty-one municipal co-permittee’s cost-share the assessment program based on jurisdictional acreage.
• The new Agreement incorporates new terminology implemented by the state in the County’s NPDES permit. It also reiterates the cost-sharing structure as established in the previous Agreement.
• Program measures effectiveness of all co-permittee’s stormwater management programs and identifies local sources where MS4 is affecting surface water quality.
The agreement will be in effect through December 31, 2025. Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

Background Information:
The County’s MS4 NPDES Permit, issued by the Florida Department of Environmental Protection (FDEP), requires continued compliance through a Water Quality Monitoring and Assessment program. The County implements this program and cost shares it with the NPDES MS4 Co-Permittees. The first Agreement was executed in 2003, followed by two (2) amendments changing program operations, cost and agreement expiration dates. The second Agreement was executed in 2012, followed by one (1) amendment for a time extension through December 31, 2020.
Fiscal Impact:
An increase of 5% has been forecasted for each consecutive year, however, that amount is subject to change annually based on changing state requirements. The County will be reimbursed 52.81% of program costs by the twenty-one (21) co-permittees on an annual basis as follows:

The total estimated expenditure and associated reimbursement is included in the Public Works operating budget (Surface Water Special Assessment Fund). This agreement is consistent with the FY20 Adopted Budget and FY21 Budget Request.
