Approval by the County Administrator of the cancellation of the contract retroactive to February 6, 2018, with L & T Brothers, Inc. d/b/a Lowes Commercial Painting (Lowes) without cause, with thirty (30) days’ notice as per page 7, paragraph 29a of the bid document for Countywide painting of exterior and infrastructure systems.

Contract No. 145-0341-B(LN) awarded in the annual amount of $140,800.00 with an approved amount to date of $704,000.00; originally effective through August 31, 2020.

Summary:

This action seeks to formally cancel the contract, without cause with thirty (30) days’ notice, for exterior and infrastructure painting services with Lowes.  After an audit of usage, purchase requests for this contract utilized the entire five (5) year approved amount, as of February 6, 2018.

 

Background/Explanation:

This contract was originally awarded by the County Administrator on September 4, 2015.  On September 7, 2017, the County Administrator approved an increase to the blanket purchase agreement.  As of February 6, 2018, there were insufficient funds left on the contract, which was set to expire on September 4, 2020.

After contract award, several exterior painting projects were performed that were not included in the original scope for bid advertisement.  Rather than increasing the existing contract, a new Invitation to Bid (ITB) solicitation process was initiated.  The work scope was increased to include the additional activities not originally captured.  The bid solicitation result was an award by the Board of County Commissioners to the incumbent, Lowes, on August 7, 2018.

The last day of service for the original contract was February 6, 2018.

 

Fiscal Impact:

 

Approved to date five (5) year expenditure not to exceed: $704,000.00

 

Estimated annual expenditure not to exceed:  $140,800.00

 

Funding was derived from each requisitioning department’s operating funds.

 

Delegated Authority:

Authority for the County Administrator to approve this contract cancellation is granted under Code Section 2-177(f).
