Authorize a public hearing to be held on March 21, 2017 amending Land Development Code (the Code) Chapter 166, Article VI, relating to the administration of surface water assessments and fees.

Summary:

These changes provide efficiencies by streamlining the annual process required to administer the surface water management services and improvement programs.  

The proposed revisions to Chapter 166, Article VI of the Code accomplish the following:

1) If the Board proposed to adopt a new maximum rate for surface water management services then an “Annual Rate Resolution” shall be adopted at a public hearing;

2) If there is no recommended change to the rate then an “Annual Rate Resolution” is not required;

3) Removes the requirement that the Board adopt a “Preliminary Rate Resolution” prior to adoption of an “Annual Rate Resolution.”  This will no longer be required as the “Annual Rate Resolution” is removed;

4) Incorporates the apportionment methodology set forth in the “Initial Rate Resolution” (as amended by subsequent “Preliminary Rate Resolutions”) into the Ordinance.

 

Background Information:

The Board created the Surface Water Assessment Program through adoption of Ordinance No. 13-14 in June 2013.  Since passage of the Ordinance, the Board has adopted preliminary and annual rate resolutions for Fiscal Years (FY) 14, 15, 16, and 17 at annual public hearings and amended the Surface Water Assessment Mitigation Policy. No rate changes are proposed. The recommended amendments to the Code, as outlined, streamline the administrative procedures of the assessment program.
