Summary:
The purpose of this action is to extend the Contract for Sale and Purchase for an additional ninety (90) days. A Limited Site Investigation Report (Report) on the parcel, dated November 14, 2016, indicated contamination on the site. Further investigation was needed to determine the extent of the onsite contamination. The final Report was received on February 13, 2017 and additional time is required to obtain additional information and make decisions on the contamination issues.
Background/Explanation:
The property has been identified for County purchase in an effort to further the Planning Department’s land assembly goals within the Lealman Community Redevelopment Area (CRA). There are a variety of potential uses for this property that could benefit the CRA, including but not limited to: regional stormwater treatment or retention, workforce training, storage, commercial or other large scale uses.
The Contract was approved by the Board on September 27, 2016. The due diligence period in the Contract is sixty (60) days from the effective date and a closing date within ninety (90) days from the effective date.
An addendum to extend the time period of the Contract for ninety (90) days, was approved by the County Administrator on November 27, 2016, to allow time to pursue additional testing and a final determination of the contamination issues on the property.
A final determination has not be reached, and therefore, an additional addendum to extend the time of the contract is required. This Addendum will extend the Contract to May 27, 2017.
The property owner is agreeable to the extension.
