Approval and execution by the County Administrator of the Addendum to the Contract for Sale and Purchase (Contract) dated September 27, 2016 to extend the due diligence period and closing date for ninety (90) days, to allow time to pursue a final determination of the contamination issues on the property. Summary:

The purpose of this action is to extend the Contract for Sale and Purchase for ninety (90) days.  A Limited Site Investigation Report on the parcel, dated November 14, 2016, indicated contamination on the site.  Additional investigation is required to determine the extent of the onsite contamination.

 

Background/Explanation:

The Contract was approved by the Board on September 27, 2016.  The due diligence period in the Contract is sixty (60) days from the effective date and a closing date within ninety (90) days from the effective date.   The additional ninety (90) days is needed to complete testing on the property.  The property owner is agreeable to the extension.

The property has been identified for purchased in an effort to further the Planning Department’s land assembly goals within the Lealman Community Redevelopment Area (CRA).  There are a variety of potential uses for this property that could benefit the CRA, including but not limited to: regional stormwater treatment or retention, workforce training, storage, commercial or other large scale uses.
