Approval of the First Amendment to the Interlocal Agreement between Pinellas County (County) and the National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) Co-Permittees for Water Quality Monitoring and Assessment program.
• Agreement is necessary for County and NPDES MS4 co-permittees to continue to implement and cost-share state-required Water Quality Monitoring and Assessment program.
• Program measures trends in water quality and identifies local sources where stormwater discharges affect surface water quality.
• Original Agreement was executed in 2020. First Amendment extends Agreement term an additional five years to December 31, 2030.
• First Amendment updates Notices section with current contacts for each municipality (co-permittees).
• County and twenty-one municipal co-permittees will continue to cost-share assessment program costs based on jurisdictional acreage cost-sharing structure outlined in Exhibit B of Agreement.
• Funding for this Interlocal Amendment (County and Florida Department of Transportation Share) is included in the Fiscal Year 2026 budget for Public Works within the Surface Water Utility Fund. Funding for future years is dependent on approval in the annual County Operating Budget.
First Amendment extends Agreement term to December 31, 2030; Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

The First Amendment to the Agreement is necessary for the County and NPDES MS4 co-permittees to continue to implement the program and cost-share the state-required Water Quality Monitoring and Assessment Program through December 31, 2030. The Amendment extends the terms and reiterates the cost-sharing structure as established in Exhibit B of the Agreement.
By the Amendment, the term is extended five years and will remain in effect until all invoices for FY 2030 are paid. Additionally, The County's performance of assessment program is extended five years to include FY 2030.

Background Information:
The County’s MS4 NPDES Permit, issued by the Florida Department of Environmental Protection (FDEP), requires continued compliance through a Water Quality Monitoring and Assessment program. The County implements this program and cost shares it with the NPDES MS4 Co-Permittees. The first Agreement was executed in 2003, followed by two (2) amendments changing program operations, cost and agreement expiration dates. The second Agreement was executed in 2012, followed by one (1) amendment for a time extension through December 31, 2020. The third Agreement was executed in 2020 which incorporated terminology implemented by the state in the County’s NPDES permit and reiterated cost-sharing structure as established in the previous Agreement.
Fiscal Impact:
The total program cost for FY 2024 for the County and co-permittees was $642,638.49. A projected increase not to exceed five percent (5%) is incorporated for each consecutive year within the Amendment, with a total program cost for the County and co-permittees not to exceed amount of $861,196.00. The total program cost amount is subject to change annually based on shifting state requirements. The County will be reimbursed 47.19% of program costs by the twenty-one (21) co-permittees on an annual basis. Furthermore, the FDOT fixed contribution is $40,000.00 per year. The total estimated expenditure and associated reimbursement is included in the Public Works operating budget Surface Water Special Assessment Fund. The Amendment is consistent with the FY 2026 Adopted Budget.
