Recommended Action

Approval and execution by the County Administrator of the Cooperative Funding Agreement with the Town of Kenneth City for the Stormwater Lake Water Quality Improvement project.

                     Agreement replaces an expired agreement.

                     Project includes design and installation of aerators in two (2) stormwater lakes to increase circulation and improve water quality.

                     Anticipated project completion date is December 31, 2020.

                     This project was approved by the Board in December 2016 and is funded by BP Economic Settlement Funds.

Total project cost is $45,000.00 with the Town of Kenneth City and the County each contributing fifty percent (50%); agreement expires on March 31, 2021.Body

Summary:


The Town of Kenneth City will install fountains and aerators in two (2) stormwater lakes, Lake Paul and Lake Lori, to improve water quality. The City facilitated the completed design and will facilitate the installation phase of the project. The previous agreement expired September 30, 2019.  The project incurred delay due to unforeseen easement acquisitions, which moved implementation past the agreement expiration date.

 

 

Background/Explanation:

Amendment No. 1 and Amendment No. 2 extended the original agreement, dated June 18, 2017, two (2) times.  This was done to provide adequate time to acquire necessary easements from Duke Energy and to complete the work.  Additionally, Amendment No. 1 revised the scope to eliminate one (1) stormwater lake from the improvement project due to neighbor concerns.

 

Fiscal Impact:

This Funding Agreement provides $22,500.00 in funding from the $7.1 million BP Economic Settlement Funds.  The funding was originally appropriated for this purpose in Fiscal Year 2017 and has not yet been expended. While the funds were not appropriated in the FY20 Adopted Budget, it is anticipated that the funds will not be required until FY21 based on the construction schedule and the appropriation will be included in the development of the FY21 budget.

The County will have no obligation related to maintenance, operation, and/or any other activity yielding a fiscal impact. The total cost of this project is $45,000, with Kenneth City providing 50% of the funding.

 

Delegated Authority:

Authority for the County Administrator to approve and execute this agreement is granted under Code Section 2-62 (a)(1).
