Recommended Action

Approval and execution by the County Administrator of the Second Amendment for a time-only extension to the Funding Agreement with the Town of Kenneth City (Town) to provide British Petroleum Economic Settlement Funds for the design and installation of fountains and diffusers in two (2) stormwater lakes.

 

                     This Second Amendment extends the duration of the Agreement an additional six (6) months from the expiration date of the First Amendment.

                     The extension is necessary due to issues related to acquiring Duke Energy easements.

                     No additional funding amount is required as part of this amendment.

Summary:

This Second Amendment extends the expiration date an additional six (6) months, from March 31, 2019 to September 30, 2019.  The extension is necessary due to issues encountered while trying to acquire the necessary easements from Duke Energy.  No additional funding is required as part of this amendment. 

 

Background/Explanation:

In an effort to improve water quality in an aesthetic manner, the Town will install fountains and aerators within Lake Paul and Lake Lori, designated as stormwater lakes.  The Town will facilitate the design and installation phases of the project.

The original agreement was entered into on June 18, 2017 to provide funding for the installation of fountains and diffusers in three (3) stormwater lakes.  The First Amendment to the agreement was entered into on August 16, 2018 to extend the expiration date from December 31, 2018 to March 31, 2019, and to shift costs to two (2) stormwater lakes from the original three (3).
