Summary
This agreement provides up to $405,652.00, anticipated to be 100% of the funding needed for design activities associated with the Starkey Road Corridor Sidewalk from Ulmerton Road (SR 688) to East Bay Drive (SR 686). FDOT will also be providing funding associated with construction costs for this project. Design activities will begin upon issuance of a notice to proceed from the FDOT. Completion of final design is to occur on or before June 16, 2021.

Background Information:
The purpose of this project is for the design of a five (5) foot wide sidewalk on Starkey Road from Ulmerton Road (SR 688) to East Bay Drive (SR 686). The project consists of approximately 9,300 linear feet of five (5) foot wide sidewalk on both sides of Starkey Road to complete gaps in the sidewalk. Total segment length is 1.520 miles.
Section 15 (b and c) of this agreement requires the County to indemnify and hold harmless the FDOT to the extent permitted by law as limited by and pursuant to the provisions of Section 768.28, Florida Statutes. County Resolution 06-70 prohibits the County from indemnifying others under most circumstances. FDOT will not modify the indemnification section of this agreement, as this is a standard requirement in its agreements. Staff and the County Attorney agree that the FDOT request is within an acceptable level or risk.
Fiscal Impact:
This project is budgeted in the Capital Improvement Program: Transportation Function, Sidewalk Projects program. Funding for this project is provided by the Infrastructure Sales Surtax (Penny for Pinellas) and is reflected in the Capital Improvement Plan under County PID # 004144A Sidewalk and ADA Program PIV. FDOT is providing $405,652.00 for the cost of design services. It is anticipated that FDOT will fund all or a portion of the cost for construction associated with the design work.
