Approval of the Local Agency Program Agreement with the Florida Department of Transportation (FDOT) and associated authorizing Resolution for construction of Starkey Road sidewalk from State Road 688/Ulmerton Road to East Bay Drive.

 

                     FDOT to fund up to $1,899,822.00 for construction and construction engineering inspection services.

                     The project consists of approximately 9,300 linear feet of five-foot wide sidewalk on both sides of Starkey Road to fill in sidewalk gaps. Total project length is 1.520 miles.

                     The County will fund $900,000 in project costs from the Penny for Pinellas Capital Improvement Program for a total estimated project cost of $2,799,822.00.

                     Construction project is ready to be advertised upon execution of the agreement.

                     Construction is anticipated to take approximately one-year to complete.

 

FDOT FPN No. 437736 2 58/68 01; County PID No. 004229A; providing $1,899,822.00 in grant funding for construction and CEI; agreement term through March 5, 2024.

Approval of this LAP Agreement will provide up to $1,899,822.00 in funding necessary to pay for construction and CEI services for Starkey Road sidewalk from SR 688 / Ulmerton Road to East Bay Drive. The engineering estimated cost of construction is $1,899,822.00.  Design work is being finalized and requirements and certifications have been submitted by the County to FDOT. Construction activities will begin upon issuance of a notice to proceed from the FDOT. Construction is expected to take approximately one (1) year with completion anticipated in November 2023.

Background Information:

The purpose of this project is construction of sidewalk along Starkey Road from SR 688 / Ulmerton Road to East Bay Drive. The project consists of approximately 9,300 LF of five-foot wide sidewalk on both sides of Starkey Road to fill in sidewalk gaps. Total project length is 1.520 miles.

Additionally, Paragraph 15 of the Agreement requires the County indemnify FDOT within the limitations of Section 768.28, Florida Statutes, which conflicts with County Resolution 06-70. FDOT has stated that the indemnification requirement is standard language, and they will not modify their boilerplate. Staff and the County Attorney agree the indemnification requirement is within an acceptable level of risk.

 

Fiscal Impact:

Funding for this project is budgeted in the Capital Improvement Program: Transportation Function, Sidewalk Projects program PID 004229A Starkey Rd. Sidewalk from Ulmerton Rd to East Bay Drive. The source of funding is provided by a federal pass-through grant administered by the FDOT through this LAP Agreement. The LAP Agreement is providing up to $1,899,822.00 for construction of this project on a reimbursement basis. Other project costs estimated at $900,000.00 will be funded by Local Infrastructure Sales Surtax (Penny for Pinellas): This agreement is consistent with the Fiscal Year (FY) 2022 Tentative Budget and FY 2022-2027 Capital Improvement Plan.
