Approval and execution by the County Administrator of the First Amendment to the Funding Agreement with the Town of Kenneth City (City) to provide British Petroleum Economic Settlement Funds for the design and installation of fountains and diffusers in three (3) stormwater lakes.

Summary:

The First Amendment extends the agreement date through March 31, 2019 to allow for documentation and payment to be completed prior to Agreement termination. Additionally, installation of fountains and diffusers will now be limited to two (2) stormwater lakes (Lake Paul and Lake Lori) due to citizen feedback.  Improvements will not be made to Lake Thomas.  Attachments to the Funding Agreement, including: Revised Exhibit A - Scope of Work, Revised Exhibit B - Project Budget, and the Revised Project Location Map have been replaced in their entirety as part of the First Amendment to reflect revisions to the project.

 

Background/Explanation:

In an effort to improve water quality in an aesthetic manner, the City will install fountains and aerators within Lake Paul and Lake Lori, designated as stormwater lakes.  The Town will facilitate the design and installation phases of the project.  Funding intended for Lake Thomas improvements will be used to address unforeseen administrative, procurement, and legal issues and expenses incurred for the two (2) remaining lakes.

 

Fiscal Impact:

No additional funding is required.  As part of the Funding Agreement, the County will provide up to $22,500.00 for the Project on a matching reimbursement basis, derived from the $7.1 million BP Economic Settlement.  The County shall have no obligations related to maintenance, operation, and/or any other activity yielding a fiscal impact.  This expense is currently reflected in the FY18 Estimate, not in the FY19 Proposed Budget.  An adjustment may be needed in the FY19 budget if the project is completed after September 30, 2018. 

 

Delegated Authority:

Authority for the County Administrator to sign this First Amendment to the Funding Agreement is granted under Resolution No. 16-90 adopted on December 13, 2016.
