Recommended Action:

Recommended Action

Approval and execution by the County Administrator of the amendment to the grant agreement with the Florida Department of Environmental Protection (FDEP) for the County Philippe Park Oyster Reef Wave Attenuation project.

 

                     FDEP has requested changes to the agreement including project title, FDEP grant manager, updates to Attachments 1, 2, 3, 5, 6, and 8, and to Exhibits A, F, and H. Additionally, Exhibit J has been added.

                     Funding amount and agreement term remains the same.

                     Grant amount previously awarded was $129,200.00 with an agreement total of $259,200.00. Agreement term ends on September 30, 2026.

                     Philippe Park Living Shoreline project (004178B) is included in the Fiscal Year 2024-2029 Capital Improvement Program plan and funded by Local Infrastructure Sales Surtax (Penny for Pinellas) and this State grant.

                     This agreement amendment does not impact the budget for Philippe Park Living Shoreline project (004178B). It is a change to the project name reflected in the agreement by incorporating Pinellas County in the name. the project manager for FDEP is also updated through this amendment.

Summary:

Agreement revisions include FDEP Grant Manager and project name change from “Philippe Park Living Shoreline Oyster Reef Wave Attenuation" to "Pinellas County Philippe Park Oyster Reef Wave Attenuation”. Attachment 1, Standard Terms and Conditions, is deleted and replaced with Attachment 1-A. Attachment 2, Special Terms and Conditions, is deleted, and replaced with Attachment 2-A. Attachment 3, Grant Work Plan, is deleted and replaced with Attachment 3-A. Attachment 5, Special Audit Requirements, is deleted and replaced with Attachment 5-A. 6.                     Attachment 6, Program-Specific Requirements, is deleted and replaced with Attachment 6-A.  Attachment 8, Contract Provisions for Coronavirus State and Local Fiscal Recovery Funds (SLFRF) Agreements is deleted and replaced with Attachment 8-A. Exhibit A, Progress Report Form, is deleted and replaced with Exhibit A-1.  Exhibit F, Final Project Report, is deleted and replaced with Exhibit F-1.  Exhibit H, Contractual Services Certification, is deleted and replaced with Exhibit H-1. Additionally, Exhibit J has been added.

 

Background/Explanation:

The County Philippe Park Oyster Reef Wave Attenuation project consists of several phases of installation of various natural elements with a goal of demonstrating resiliency against storm surges and sea level rise, creating salt marsh and oyster reef habitat, and promoting similar projects along other shorelines in the County and throughout the region. The oyster reef Wave Attenuation Barriers are the focus of this grant funding and have been designed and permitted.

The Grant amount awarded was $129,200.00 with an Agreement total of $259,200.00
, approved by the Board of County Commissioners on November 15, 2022. Agreement term ends on September 30, 2026.

 

Fiscal Impact:

This agreement amendment does not impact the budget for Philippe Park Living Shoreline project (004178B). It is a change to the project name reflected in the agreement by incorporating Pinellas County in the name. the project manager for FDEP is also updated through this amendment.

 

Delegated Authority:

Authority for the County Administrator to sign this Amendment is granted under Code Section 2-62 (a)(1).
