Based upon the evidence and findings contained in the staff report and attachments, Case No. ZON-23-08 is recommended for approval.

 

A resolution approving the application of Jessica Alvarez for a zoning change from Residential Planned Development (RPD), to Single Family Residential (R-2).

 

                     The applicant is seeking a zoning change on a 1.88-acre vacant parcel.

                     A single family detached home is proposed.

                     The subject property is surrounded by a variety of residential housing types.

                     The Local Planning Agency recommended approval of the request (vote 4-0). No one appeared in opposition and one letter of concern has been received.

Summary:

Summary

The subject property consists of one (1) vacant parcel totaling approximately 1.88 acres located on the southeast corner of West Lake Road and Backus Road in Palm Harbor. The property is designated Residential Low (RL) and Preservation (P) on the Future Land Use Map (FLUM), which allows up to five (5) residential units per acre (uplands only) and it is currently zoned RPD. The RPD zoning allows for wide variety lot sizes and housing types, however a new Development Master Plan (DMP) that establishes the permitted uses and development parameters (e.g., setbacks, building height, etc.) would be required. 

The proposed zoning amendment to R-2 is considered a down zone of the property and allows only single-family detached homes. The applicant has indicated a desire to construct one (1) single-family home on the site. In comparison, the existing RPD zoning with creation of a DMP could allow for a variety of mixed residential units.

The subject property is within a mixed residential area having lots of various widths and sizes. Immediately east is a single-family home and to the north is a single-family detached residential subdivision. Two (2) multi-family townhome communities exist to the west and south.
                     
Staff finds that the proposed Zoning Atlas amendment to R-2 is appropriate for the subject property and is consistent with the Pinellas County Comprehensive Plan. The proposed request will provide for a single-family detached home that is compatible at a density and scale with the surrounding development pattern.
