Recommended Action:

Recommended Action

Recommend the adoption of the attached resolution dedicating a portion of County-owned property, along 134th Avenue North, as right-of-way.

 

                     This portion of County-owned property has been improved by the County, including roadway, sidewalks, and/or drainage improvements.

                     The property is being used as public right-of-way and has not been previously dedicated as such.

                     There is no fiscal impact to the County for declaring public right-of-way.

 

Authorize the Chairman to sign and the Clerk of the Court to attest and record the resolution declaring County-owned property right-of-way in the public records of the County.

Approval of resolution declaring a portion of County owned property as right-of-way. County has treated the property as right-of-way, including making roadway, sidewalk, and drainage improvements. Research was conducted, and it was determined that the property had never been dedicated as right-of-way.

Background Information:

Public Works’ Survey Division prepared a boundary survey for a recently acquired parcel. The boundary survey showed roadway, sidewalks and drainage improvements within the now County owned property.  

Based on the information gathered from the boundary survey, approximately 8,000 square feet of the County-owned property, fronting 134th Avenue North, has been improved by the County but never declared as public right-of-way.

 

Fiscal Impact:

There is no cost to the County for declaring public right-of-way.
