Recommend consideration of the Colburn’s (Appellants) request for a public hearing to appeal the issuance of County Dock Permit No. WND-22-00252 for 1605 Pass-a-Grille Way, St. Pete Beach (Subject Property).

 

                     Rostam Holding LLC applied for a permit to construct a new multi-use facility dock with six slips at the Subject Property.

                     County Water and Navigation Staff issued Permit WND-22-00252 on March 27, 2023.

                     Appellants own property at 1701 Pass-a-Grille Way, a vacant lot located north of the Subject Property across a fifty-foot-wide City right-of-way, and 1803 Pass-a-Grille Way, located approximately 375 feet north of the Subject Property.

                     Appellants filed a request to appeal the issuance of said permit on April 25, 2023, in accordance with County Code, Section 58-536(b) - Appeals, citing concerns with permitting procedures, lack of prior knowledge of the permit, lack of public notification, increased boat traffic, scale of the project, and proximity to an existing local marina.

Summary

Staff issued Dock Permit WND-22-00252 on March 27, 2023. Section 58-536(b) of the Code provides thirty (30) days for appeals where the appellant(s) must state the grounds upon which staff have erred in its findings. The Board of County Commissioners (Board) may grant or deny a public hearing to determine whether Staff erred in granting the permit. Staff have reviewed the appeal and issues raised by the Appellants and finds the issuance of the permit was appropriate. The Appellants wish to petition the Board to hold a public hearing to determine whether Staff erred in granting the permit.

Background Information:

Rostam Holding LLC, property owner at the Subject Property, applied for a permit to construct a new multi-use facility dock with six (6) slips. Staff issued the permit on March 27, 2023.  On April 26, 2023, Staff received an email from the Appellants requesting an appeal of this permit, and outlining how this project is inconsistent with multiple sections of Article XV of the County Code.
