Approval and execution by the County Administrator of the mutual termination agreement with Lawns Today, LLC for landscape and ground maintenance services.
• This contract was for routine mowing services in addition to edging, weeding, tree, shrub, and palm pruning and mulching, irrigation system maintenance and repair, pest control, and fertilizing at various Pinellas County Utilities locations.
• This termination agreement represents both the vendor and Utilities staff mutually agreeing to terminate the contract, effective April 16, 2023, primarily due to the understated requirements that were originally solicited with this contract.
• The contract originally awarded to Lawns Today did not encompass all of the acreage required for landscaping services. A new contract was solicited and is in process for award to replace this contract via Legistar file no. 22-1686A that includes updated requirements and scope.
• There is no fiscal impact to the County for terminating this agreement.
• The County Administrator has delegated authority under 2-62(a)(2) to mutually terminate contracts approved by all parties to the contract that were originally approved by the Board of County Commissioners (BCC).
• The BCC awarded this contract to Lawns Today, LLC on March 8, 2022, in the amount of $482,163.45 for a thirty-six-month term. The First Amendment, approved by the Division Director of Purchasing and Risk added additional acreage with no change to the upset limit; however, the vendor had difficulty keeping up with the additional acreage.

Summary:
This request mutually terminates the contract with Lawns Today effective April 16, 2023. A new contract is in process for award that will ensure all facilities owned and operated by Utilities can be maintained to County standards.
Background/Explanation:
The Landscape and Grounds Maintenance Services Invitation to Bid was issued on November 1, 2021. Lawns Today, LLC was awarded the contract for maintenance of Utilities facilities. The price page that accompanied the Invitation to Bid was incorrect, underestimating the size of the Utilities facilities by 40.34%. The First Amendment, approved by the Division Director of Purchasing & Risk added additional acreage with no change to the upset limit.
On November 30, 2022, the Purchasing and Risk Management Division released a request for proposal on behalf of the Utilities department with the intent to establish a new contract for facility landscape and irrigation services.
Fiscal Impact:
There is no fiscal impact to the County for terminating this agreement.
Delegated Authority:
Authority for the County Administrator to approve and execute this mutual termination agreement is granted under Code Section 2-62 (a)(2).
