Summary:

Summary

The Board, via Resolution 21-45, agreed to participate in state-wide settlement with the Attorney General.  In addition to authorizing the County Administrator to execute the final MOU setting forth the Florida Plan, the Resolution authorizes the County Administrator to execute “any formal agreements implementing a unified plan for the allocation and use of opioid settlement proceeds that is not substantially inconsistent with the Florida Memorandum of Understanding and this Resolution, subject to approval as to form by the County Attorney’s Office.”  The Participation Agreements were reviewed and approved as to form by your outside counsel and the County Attorney’s Office.  Thereafter, these Agreements were executed by the County Administrator. 

The Participation Agreements effectuate the unified plan for allocation and use of settlement proceeds in that the amount of money that flows to Florida is based, at least in part, on the Attorney General’s representation regarding the number of participating governmental entities. 

It is requested that participation in the settlements with McKesson Corporation, Cardinal Health, Inc. and AmerisourceBergen Corporation (the “Settling Distributors), Janssen, Endo, Teva, Allergan, CVS, Walgreens and Walmart be ratified.
