Recommended Action

Adopt a resolution approving a first substantial amendment to the Fiscal Year 2021-2022 Annual Action Plan for the purpose of receiving an allocation of HOME Investment Partnerships Program - American Rescue Plan (HOME-ARP) funds and authorize submittal to the U.S. Department of Housing and Urban Development (HUD).

 

                     The First Substantial Amendment contains the HOME-ARP Allocation Plan for the HOME-ARP funds.

                     The County will receive $4,794,571.00 in HOME-ARP funds to fund activities that provide homelessness assistance and supportive services.

                     The County held three HOME-ARP consultation/ needs assessment forums to consult with the Continuum of Care, local housing and public service providers, grantee departments, and other groups that work to address the needs of qualifying populations. Approximately 55 participants from approximately 30 various organizations and 3 municipalities attended the forums.

                     The First Substantial Amendment allows the County to receive HOME-ARP funds and identifies the types of activities that will primarily benefit qualifying individuals and families who are homeless, at risk of homelessness, or in other vulnerable populations (Qualifying Populations).

                     Eligible HOME-ARP activities include but are not limited to: HOME-ARP rental housing, tenant based rental assistance, supportive services, non-congregate shelters, nonprofit operating and capacity building assistance, and administration.

 

Authorize the Chairman to sign and the Clerk of the Circuit Court to attest applications, certifications, and HUD Grant Agreements; Authorize the Chairman, or designee, to sign Request for Release of Funds and Authority to Use Grant Funds; Authorization for the Chairman, or designee, to sign and the Clerk to attest Specific Performance and Land Use Restriction Agreements, and Amendments; Authorize the County Administrator to implement HOME-ARP Programs; Authorize the County Administrator, or designee, to execute Housing Program Security Instruments, Agency Agreements, and Land Use Restriction Agreements, and Amendments; Authorize the Housing and Community Development Department Director to serve as local administrator for the HUD Environmental Review Online System; and Authorize the Housing and Community Development Department Director to sign and file necessary forms, reports, and other administrative documents related to the administration of the First Substantial Amendment.

The First Substantial Amendment allows the County to receive HOME-ARP funding and identifies the types of activities that will primarily benefit the Qualifying Populations (individuals and families who are homeless, at risk of homelessness, or in other vulnerable populations).

Public notice of the proposed First Substantial Amendment was posted on the Community Development Division website on November 30, 2022. A 15-day public comment period was held from November 30, 2022, to December 15, 2022, soliciting citizen comment on the First Substantial Amendment.

Background Information:

On March 11, 2021, President Biden signed American Rescue Plan (ARP) into law, which provides over $1.9T in relief to address the continued impact of the COVID-19 pandemic on the economy, public health, State and local governments, individuals, and businesses.

To address the need for homelessness assistance and supportive services, Congress appropriated $5B in ARP funds, to be administered through the HOME Program, to perform four (4) activities that must primarily benefit qualifying individuals and families who are homeless, at risk of homelessness, or in other vulnerable populations. These activities include: One (1) development and support of affordable housing, two (2) tenant-based rental assistance (TBRA), three (3) provision of supportive services; and  four (4) acquisition and development of non-congregate shelter units.

 

Fiscal Impact:

The County has been awarded HOME-ARP funds totaling $4,794,571.00. The FY23 Adopted Expenditure Budget includes $4,474,840.00 and FY22 Adopted Estimate includes the remainder $239,731.00. The funding is fully available and budgeted in the Community Development Grant Fund within Housing and Community Development Department.
