Recommended Action

Approval of the non-competitive purchase agreement (Agreement) with Pinellas Community Foundation (PCF) to administer the American Rescue Plan Act (ARPA) Nonprofit Capital Projects Fund.

 

                     The Agreement creates a subrecipient relationship between the County and the PCF and requires that the PCF design and implement a Nonprofit Capital Project Fund in accordance with the ARPA State and Local Fiscal Recovery Fund rules and regulations and additional County terms and conditions. The Fund will provide funding to Pinellas County nonprofits to purchase, refurbish or build capital assets including, but not limited to, vehicles, industrial refrigeration units and facilities.

                     The Agreement has a term through December 31, 2026, with a total expenditure not to exceed $1,033,000.00.

 

Contract 22-0557-N (JJ); in the estimated expenditure of $1,033,000.00 effective through December 31, 2026; Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

Summary

The ARPA SLFRF provides for support for nonprofit organizations that have been impacted by the pandemic. This Agreement is to administer the ARPA Nonprofit Capital Projects Fund that allocates approximately $19,000,000.00 to Pinellas County nonprofits that have been impacted by the COVID-19 pandemic. The Fund is intended to support the purchase, construction or refurbishment of capital assets by nonprofits.

On January 11, 2022 the Board approved, in concept, the ARPA Nonprofit Capital Projects Fund with a budget of $19,000,000.00 as part of the ARPA Spending Plan.

A needs assessment conducted in February 2022 revealed there is a need for vehicles, computer hardware, software, equipment, buildings and land.


A competitive solicitation for a contract to administer the ARPA Nonprofit Capital Projects Fund was initiated in late April 2022 and no proposals were received. The Non-Compete Committee subsequently reviewed this item as a non-compete agreement request and approved the item to move forward on May 24, 2022.

Background Information:

On May 10, 2021, Treasury announced the launch of the Coronavirus State and Local Fiscal Recovery Fund (SLFRF), established by the American Rescue Plan Acct of 2021 (ARPA), to provide $350 billion in emergency funding for eligible state, local, territorial and Tribal governments. Treasury also released details on how these funds can be used to respond to acute pandemic response needs, fill revenue shortfalls among these governments and support the communities and populations hardest hit by the COVID-19 pandemic. Economic support for nonprofit organizations is specifically mentioned as a qualified expenditure of SLFRF in the Treasury Final Rule and other supporting documentation.

Pinellas County is eligible to receive $189,381,543.00 from the SLFRF and 50% of the funding ($94,690,770.00) was received on August 12, 2021. The second 50% will be received after August 12, 2022. All funds must be obligated by December 31, 2024 and spent by December 31, 2026. A new fund has been created within the County’s accounting structure to facilitate tracking and reporting of the expenditure of these funds.


On October 26, 2021 the Board appropriated the first tranche of the SLFRF in the amount of $94,690,770.00.

On January 11, 2022, The Board approved, in concept, the County’s ARPA Spending Plan, which includes $19,000,000.00 for the ARPA Nonprofit Capital Projects Fund.


In February 2022, the County conducted a Needs Assessment with Pinellas County nonprofit organizations to determine the size and scope of the need for capital assets as a result of negative economic impact from the COVID-19 pandemic. The ARPA Nonprofit Capital Projects Fund is intended to meet those needs. The Needs Assessment is attached as an Exhibit to the Agreement.

A competitive solicitation for a contract to administer the ARPA Nonprofit Capital Projects Fund was initiated in late April 2022 and no bids were received. Subsequently, Staff commenced negotiations with the PCF for this non-competitive agreement in compliance with 2 CFR 200.320(C)(5).
