Approval of the Cooperative Funding Agreement with the Southwest Florida Water Management District (SWFWMD) for water quality improvements at the Starkey M10 Stormwater Facility, located near 126th Avenue and Starkey Road.

 

                     Agreement provides $324,000.00 in SWFWMD funding.

                     County match of $324,000.00 is programed in the Penny for Pinellas Capital Improvement Program six-year plan.

                     Funding will be allocated for construction, construction engineering inspection, geographical information systems data, and as-built survey for construction of a fixed weir and excavation of one and construction of another stormwater pond.

                     Work under this Agreement is part of the water quality improvements at the Starkey M10 Stormwater Facility expected to advertise for bid in early summer 2022.

 

SWFWMD Agreement No. 22CF0003715 and SWFWMD Project No. W106; County Project No. 003900A; Agreement provides $324,000.00 in SWFWMD funding; Agreement expires June 21, 2025; Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

Summary

The Agreement provides $324,000.00 in grant funding from SWFWMD for the construction of a stormwater pond and a weir to improve water quality discharging to Boca Ciega Bay within the Tampa Bay watershed. This partnership pays for approximately fifty percent (50%) of the cost. The County will provide $324,000.00 in matching funds.  Total anticipated construction cost associated with the SWFWMD agreement 22CF0003715 is $648,000.00.

The Starkey M10 Stormwater Facility Quality Improvement project provides several benefits including treating over one hundred (100) acres of stormwater runoff and reducing pollutant loads entering Tampa Bay, a SWFWMD Surface Water Improvement and Management priority water body.

Background Information:

Work under this Agreement includes construction of a fixed weir at the downstream end of the existing Starkey M10 permitted stormwater facility near 126th Avenue North, and excavation of a pond on a County-owned parcel on the north side of Channel 6 east of Starkey Road.  Additionally, construction of another stormwater pond on County-owned land south of Channel 6 to serve a future Starkey Road widening project is included in the scope of work for the project but is not included in this Agreement.

Paragraph 12.2 of the Agreement, pursuant to the provisions of Section 768.28, Florida Statutes states the County shall indemnify and hold SWFWMD harmless, which the County does not do per Resolution 06-70 attached.  However, SWFWMD is historically unwilling to alter liability/indemnity language in its form cooperative funding agreements.  The County Attorney has documentation from SWFWMD legal counsel stating that the County should assume as much until SWFWMD advises otherwise. Consequently, SWFWMD will not change its liability/indemnity language in this funding agreement.

 

Fiscal Impact:

Project 003900A - Stormwater Starkey Facility M10 Modification is included in the Fiscal Year (FY) 2022-2027 Capital Improvement Program Six-Year Plan: Physical Environment Function; Surface Water Quality Projects Program. The County portion of this project is funded by the Local Infrastructure Sales Tax (Penny for Pinellas).SWFWMD is providing the other fifty percent (50%), or $324,000.00 of the $648,000.00 estimated cost of total construction and construction engineering inspection, geographic information systems date, and as-builts. SWFWMD funding is approved for FY 2022. Total amount of funding budgeted for construction of the Project is $1,897,000.00.

 

Starkey M10 Stormwater Facility Project funding sources include:

                     Local Infrastructure Sales (Penny for Pinellas) in the amount of $1,573,000.00.

                     SWFWMD funding in the amount of $324,000.00.
