Approval of the Florida Shared-Use Nonmotorized Trail Network Agreement (Agreement), including associated Resolution, and Maintenance Memorandum of Agreement (MMOA) with the Florida Department of Transportation (FDOT) for funding to complete design services for the Pinellas Trail Loop, Phase 4 from 126th Avenue North to Ulmerton Road.

 

                     Agreement provides a maximum amount of $293,627 for design of the Pinellas Trail Loop, FDOT Phase 4, from 126th Avenue to Ulmerton Road.

                     This location, which is 0.82 mile, is part of the Pinellas Trail Loop South Gap and referred to by the County and reflected in the Overall Segment Map as Phase I of the Pinellas Trail South Gap Project (red segment).

                     FDOT requires a construction MMOA, to be signed in conjunction with the Agreement as it is anticipated the County will also receive construction funding from FDOT in the future.

                     The Board of County Commissioners is required to approve the Agreement by Resolution.

                     Total design services for this segment are estimated to be $564,944. The County has the difference of $271,317 budgeted in the CIP, funded by Penny for Pinellas Local Infrastructure Sales Tax.

 

PID No. 003883A; FDOT Agreement No. 440093 3 34 01 for a total of $293,627; Agreement term is through June 30, 2023; Authorize the Chairman to sign and the Clerk of the Circuit Court to attest the agreements.

Summary:

Summary

This Agreement provides grant funding for the design portion of FDOT Phase 4 of the Pinellas Trail Loop, from 126th Avenue North to Ulmerton Road, which is part of the Pinellas Trail South Gap location. This portion of the Trail, which is referred to by the County as Phase 1 of the Pinellas Trail South Gap, connects into the existing and committed Trail segments and infrastructure. Ultimately this location will create a Trail loop within the County with the completion of the South Gap County-named Phase 2. Additional detail regarding County-named Phase designations is included in the Overall Segment Map attachment. Furthermore, the MMOA is a requirement of the Agreement and defines the maintenance responsibilities of the Trail once it is constructed.

Grant funding is a maximum amount of $293,627 for design services. The County will bear all expenses over the amount of FDOT participation, and any cost overruns or deficits involved.  Actual anticipated total cost of design for the Project is $564,944.  Thus, the amount over the grant funded amount is the County’s responsibility and funded by the Penny for Pinellas Local Infrastructure Sales Tax.

Background Information:

The County and Forward Pinellas have adopted the Countywide Trailways Plan that includes a 75-mile trail loop. Currently, the Pinellas Trail North Gap is under construction. The North Gap of the Trail is 9.6 miles in length and will connect the northern terminus of the Pinellas Trail Loop to the existing section of the Duke Energy Trail. The Pinellas Trail South Gap is the remaining section in the Pinellas Trail Loop. The South Gap is 8.9 miles in length. The segment which the FDOT Agreement addresses is 0.82 miles in length. It is anticipated the County will manage the entire Pinellas Trail Loop South Gap design and construction.

The Pinellas Trail Loop provides a vital link to the emerging Southwest Coast Regional Trail and the Courtney Campbell Causeway Trail, as well as providing a critical connection to the Coast-to-Coast Trail. Completing this Trail Loop will connect low income and minority areas, as well as provide connection to employment opportunities, educational facilities, and other community resources through a vibrant non-motorized, multi-modal transportation network. The economic and safety benefits of completing this Trail Loop remain a priority for our local and regional government agencies, businesses, citizens, and visitors. The Trail Loop also provides safe, multi-modal opportunities with connectivity to transit, ride share, bike lanes, and other facilities.

Pertaining to the Florida Shared-Use Nonmotorized Trail Network Agreement, the County will include the following indemnification language in the Standard Purchase Order issued to the consultant who performs work in connection with this Agreement:

“To the fullest extent permitted by law, the County’s consultant shall indemnify and hold harmless the County and the FDOT, including the Department’s officers and employees, from liabilities, damages, losses and costs, including, but not limited to, reasonable attorney’s fees, to the extent caused by the negligence, recklessness or intentional wrongful misconduct of the contractor/consultant and persons employed or utilized by the contractor/consultant in the performance of this Agreement.”

The County’s design Consultant for the subject segment has updated its insurance certificate accordingly.

 

Fiscal Impact:

The County is requesting $293,627 of grant funding with a total estimated cost of $564,944 for design. The County will provide the difference of $271,317, which is budgeted in the Capital Improvement Program. The funding source for the County’s portion is the Local Infrastructure Sales Tax (Penny for Pinellas) and is reflected in the Capital Improvement Plan under PID # 003883A Pinellas Trail South Gap - 126th Ave N to Ulmerton Rd.
