Third Amendment to the Community Development Block Grant Program Subaward Specific Performance and Land Use Restriction Agreement CD20PARCCV with PARC, Inc. for Community Development Block Grant funded facility improvements.

 

Recommended Action:

 

Approval and execution by the County Administrator of the Third Amendment to the Community Development Block Grant Program Subaward Specific Performance and Land Use Restriction Agreement (Third Amendment) with PARC, Inc. (PARC), for Community Development Block Grant (CDBG) funded facility improvements.

 

                     This Third Amendment extends the term of Agreement CD20PARCCV, six (6) months to September 30, 2022, to provide additional time for project completion and extends the term of the restricted period six (6) months, restricting the use of the property through October 1, 2027.

                     The funding amount, not to exceed $47,875.00 during the term of the Agreement, remains unchanged.

                     On September 18, 2020, the County provided CDBG funding to PARC for energy efficiency upgrades at the Curry Villa Group Home located at 5825 - 66th Street North, St. Petersburg, Florida 33709.

                     On July 29, 2021, the First Amendment extended the term of the Agreement to December 31, 2021, to provide additional time for project completion and extended the term of the restricted period to January 1, 2027.Body

                     On December 14, 2021, the Second Amendment extended the term of the Agreement to March 31, 2022, to provide additional time for project completion and extended the term of the restricted period to April 1, 2027.

Summary:

 

This Third Amendment extends the term of Agreement CD20PARCCV six (6) months to allow for project completion and extends the term of the restricted period.

In order to connect the solar energy system to the meter, upgrades to the existing transformer are required. Due to delays by Duke Energy making the necessary transformer upgrades, PARC is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement six (6) months, to September 30, 2022. As a result of the term extension, it is necessary to extend the term of the restricted period six (6) months, restricting the use of the property through October 1, 2027.

 

This Third Amendment will not have a fiscal impact. The total CDBG investment for this project is not to exceed $47,875.00.

 

The Agreement is effective through September 30, 2022. The use of the property is restricted to serving low- to moderate-income individuals with intellectual and developmental disabilities through October 1, 2027.

 

Background/Explanation

 

On July 21, 2020, the Board executed Resolution 20-69, which approved the 2020-2021 Action Plan. The Curry Villa Facility Rehabilitation project was approved as a facility rehabilitation activity in the 2020-2021 Action Plan.

 

On September 18, 2020, the County Administrator executed Community Development Block Grant Program Subaward Specific Performance and Land Use Restriction Agreement CD20PARCCV, benefitting individuals with intellectual and developmental disabilities. The Agreement was effective October 1, 2020 through September 30, 2021 with the land use restriction expiring on October 1, 2026. On July 29, 2021, the County executed the First Amendment to Agreement CD20PARCCV extending the term of the Agreement through December 30, 2021 and the land use restriction through January 1, 2027. On December 14, 2021, the County executed the Second Amendment to Agreement CD20PARCCV extending the term of the Agreement through March 31, 2022 and the land use restriction through April 1, 2027.

 

Fiscal Impact:

 

There is no fiscal impact. The total amount of funding for this project is not to exceed $47,875.00 during the term of the Agreement. Funding for this Agreement is included in the County’s Fiscal Year 2022 (FY22) Adopted Budgets for CDBG funds.

 

Delegated Authority:

 

Authority for the County Administrator to sign this Agreement is granted under Code Section 2-62(a)(1).
