Approval of the Road Transfer Interlocal Agreement with the City of Clearwater for the transfer and acceptance of specific roadway segments and easements.

 

                     The County is partnering with municipalities to transfer right-of-way and maintenance responsibility for streets within, or partially within, municipal limits.

                     Agreement transfers operation and maintenance responsibilities of various road segments to the City (17.01 centerline miles).

                     Transfers include maintenance responsibilities for stormwater facilities.

 

Authorize the Chairman to sign and the Clerk of the Circuit Court to attest the Interlocal Agreement and record the Interlocal Agreement with Exhibits A, B and C, record separately Exhibit C, and the corresponding right-of-way maps (Mylars) in the official records of the County.

Summary

The Road Transfer Interlocal Agreement provides for the transfer of jurisdiction and associated maintenance responsibilities, including stormwater facilities and for certain road segments in the City of Clearwater. Specific segments are detailed in Exhibit A to this Agreement. Total length of the segments is 17.01 centerline miles.

Background Information:

The Department of Public Works is partnering with County municipalities to better define right-of-way maintenance responsibility in areas where jurisdictional boundaries are shared. This Road Transfer Interlocal Agreement serves to transfer jurisdictional responsibility for designated public road segments that are within, or partially within, the City municipal limits.

The City and County agree that it is in the best interest of the parties that responsibilities associated with operation, maintenance, planning, design and construction of the identified road segments, along with any future improvements thereto, be transferred to the City or County as detailed in Exhibit A.  The City or County accept all legal rights of the roadway segments that are within, and appurtenant to, the right-of-way being transferred.

 

Fiscal Impact:

Public Works has identified several “enclaved” areas of county responsibility within city jurisdictions that are more conducive to local travel rather than thru travel. It has been decided that from an efficiency perspective for maintenance, the maintaining of the right of way for these properties is better suited for the City of Clearwater.

 

Most agreements that have transferred right-of-way from the County to cities have resulted in no cost savings as the right-of-way was already being maintained by cities. For this agreement in particular several portions transferred will likely represent a cost savings to the County. Eliminating maintenance of roadway in enclaves specifically will result in cost savings from an efficiency of access perspective. Estimating the total cost savings is difficult in this circumstance as a standard mileage metric is not available.
