Recommended Action

Approval of two agreements and waiver of the Philanthropic Naming Rights Policy to provide for the construction of a children’s garden on the grounds of the Florida Botanical Gardens and to accept funding from the Majeed Foundation for naming rights to the children’s garden.

 

                     Approval of a license agreement with the Florida Botanical Gardens Foundation (FBG Foundation) for the construction of a children’s garden within the Florida Botanical Gardens.

                     Approval of an agreement with the Majeed Foundation (Majeed) for $600,000.00 donation for the naming rights of the children’s garden.

                     Request the Board waive the Philanthropic Naming Rights Policy with the understanding this project is being undertaken by the FBG Foundation as project manager.

                     Funding for the estimated $2.3 million facility is comprised of $600,000.00 Majeed donation, additional private donations, and cash reserves from the FBG Foundation.

                     Both agreements are required for the funding and construction of this project to move forward with anticipated commencement and completion of the project in calendar year 2022.

Summary

Parks and Conservation Resources (PCR) has partnered with the FBG Foundation to conceptualize and design a children’s garden to enhance the visitor experience at the Florida Botanical Gardens (FBG). Implementation of this project requires funding and construction management, which is a challenge the FBG Foundation has chosen to take on through their operation. The funding for this project has been completely raised by the FBG Foundation with a major donation coming from the Majeed Foundation in the amount of $600,000. For this donation the Majeed and the FBG Foundation wish to provide naming rights to the children’s garden to be called the Majeed Discovery Garden. The total cost for the construction of the new Majeed Discovery Garden is approximately $2.3 million, and construction is scheduled to begin in January of 2022.

Background Information:

The FBG Foundation is a not-for-profit citizen support organization that works in partnership with PCR to enhance the FBG ecosystem, infrastructure, and visitor experience. The Operating Agreement in place with the FBG Foundation, which is current and in good standing, establishes the guidelines for the relationship. The two agreements requiring approval in this request provide the basic legal mechanism for the County, the FBG Foundation, and Majeed to develop the new children’s garden.

 

Fiscal Impact:

This project will require no additional funding from the County for construction. General maintenance will be handled by PCR using existing resources already included in the FY22 Proposed Budget. Future repair or replacement costs (Exhibit D, Attachment I - FBGF Agreement) will be split evenly between the FBG Foundation and the County (Parks Group 3 - Northcentral) as resources are available. All revenue generated from Majeed Discovery Garden bookings and events generated by either the FBG Foundation or the County will be split evenly between the County and the FBG Foundation.
