Recommended Action:

Approval and execution by the County Administrator of the Second Amendment to the Specific Performance Agreement (Second Amendment) with Safety Harbor Neighborhood Family Center, Inc., d/b/a Mattie Williams Neighborhood Family Center (Mattie Williams NFC), for food distribution to respond to the Coronavirus pandemic (COVID-19).

 

                     On August 13, 2020, the County provided $40,000.00 in Community Development Block Grant - Coronavirus Response (CDBG-CV) funds for costs associated with transitioning to a drive-thru food distribution process, pick-up food distribution, food storage and supplies at the Mattie Williams NFC through Agreement CDCV19SHNFC.

 

                     This Second Amendment revises the scope of the project to include the Agency’s second property location, 1003 Dr. Martin Luther King Street North, Safety Harbor, Florida 34695, as a project site.

 

                     This Second Amendment extends the term of the Agreement six (6) months to September 30, 2021, to allow Mattie Williams NFC to continue providing food distribution to low- and moderate-income households in the County.

 

                     The Mattie Williams NFC provides services to approximately 320 low- and moderate-income households

 

                     The total funding amount remains unchanged and is not to exceed $40,000.00 during the term of the Agreement.

Summary:

This Second Amendment to Specific Performance Agreement CDCV19SHNFC modifies the project description to add a second property location, 1003 Dr. Martin Luther King Street North, Safety Harbor, Florida 34695. Food distribution services will be provided at this second location in addition to the originally identified property location of 1001 Dr. Martin Luther King Street North, Safety Harbor, Florida 34695. The Mattie Williams NFC is comprised of both property addresses.

 

The project description in the original Agreement identified food distribution services would be provided at 1001 Dr. Martin Luther King Street North, Safety Harbor, Florida 34695 and excluded the 1003 Dr. Martin Luther King Street North, Safety Harbor, Florida 34695 location as a part of the project site.

 

This Second Amendment will also extend the term of the agreement to allow Mattie Williams NFC to continue providing food distribution services to low-income households in the County.  Mattie Williams NFC has experienced delays in obtaining the associated permitting needed for the project.

 

This Second Amendment will not have a fiscal impact. The total CDBG-CV investment is not to exceed $40,000.00.

 

The Agreement is effective through September 30, 2021.

 

Background/Explanation

On March 27, 2020, the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 116-136, was signed providing funds to respond to the growing effects of COVID-19. The County received $1,481,969.00 in CDBG-CV funding from the U.S. Department of Housing and Urban Development to be used to prevent, prepare for, and respond to COVID-19. CDBG-CV funds must be expended within six (6) years from the date of the executed grant agreement with HUD.

 

On July 21, 2020, a Substantial Amendment to the 2019-2020 Action Plan was approved by the Board of County Commissioners (Board) in Resolution 20-68, to include CDBG-CV funds in order to carry out eligible activities that mitigate the impacts of COVID-19 on low- and moderate-income residents.

 

On August 13, 2020, the County Administrator executed Specific Performance Agreement CDCV19SHNFC, effective March 27, 2020 through December 31, 2020, providing $40,000.00 in CDBG-CV funds for costs associated with transitioning to a drive-thru food distribution process, pick-up food distribution, food storage and supplies at the Mattie Williams NFC through Agreement CDCV19SHNFC.

 

On December 21, 2020, the County Administrator executed the First Amendment to Specific Performance Agreement CDCV19SHNFC, extending the term of the Agreement three (3) months to March 31, 2021.

 

Fiscal Impact:

The total amount of funding for this agreement is not to exceed $40,000.00 during the term of the Agreement. Funding for this Agreement is included in the County’s Fiscal Year 2020 (FY20) Revised Budget and Fiscal Year 2021 (FY21) Adopted Budget for CDBG-CV funds.

Authority for the County Administrator to sign this Agreement is granted under Code Section 2-62 (a) (1).
