Approval and execution by the County Administrator of the First Amendment to the Joint Project Agreement (JPA) with the City of Clearwater for utility work associated with the Sunset Point Road at Betty Lane Intersection Improvement project.

 

                     Section 1 project description for Utility Work is amended and Section 2 Paragraph 2.2 Funding is amended in its entirety.

                     City required to provide an additional $333,108.17 per the Agreement for City project scope revisions made by County contractor.

                     Utility work under the JPA is now complete.  County to pay contractor with these funds for City utility project work performed in County right-of-way.

Summary:

The First Amendment revises Agreement Section 1 project description for Utility Work. Additionally, Section 2 Paragraph 2.2 Funding is amended in its entirety.  The agreement allows the City to make an additional payment to the County pursuant to Paragraph 2.2 for cost overrun.  In this case, the City is required to provide an additional $333,108.17 per the amended agreement for City project scope revisions made by County contractor. The County’s contractor has completed City of Clearwater utility work associated with the JPA.  The County will pay contractor with these funds for City utility project work performed in County right-of-way, with exception of a five percent (5%) administrative fee of $15,862.29.  The County’s existing contract with the project contractor will also be amended per change order in the amount of $317,245.88 (not including the administrative fee received by the County) to reflect this first amendment to the JPA.

 

Background/Explanation:

The County improved, reconstructed and/or replaced the City’s existing water mains as part of a larger planned intersection improvement project on Sunset Point Road at Betty Lane.  Through this JPA, the County and the City mutually agreed it is economically beneficial to have the County’s contractor perform the City’s utility work as part of construction of the overall project.  Primary work performed on behalf of the City was replacement, relocation or adjustment of approximately 1,034 linear feet (LF) of sixteen-inch (16”) water main, and approximately 377 LF of eight-inch (8”) water main and 22 LF of six-inch (6”) water main in conflict with the proposed intersection construction improvements located on Sunset Point Road at Betty Lane.  These quantities are amended per the First Amendment.

 

Fiscal Impact:

This amendment is consistent with the FY21 Budget.

 

Delegated Authority:

Authority for the County Administrator to approve and execute this amendment is granted under Code Section 2-62 (a)(2).
