Approval and execution by the County Administrator of Change Order No. 2 (final) with Kamminga & Roodvoets, Inc. (Kamminga) for the McKay Creek Water Quality Improvement Project.

 

                     The purpose of this project was to construct two water quality treatment ponds with the McKay Creek watershed.

                     Change Order No. 2 (final) decreases the contract by ($84,965.72) due to the difference between estimated and final quantities in addition to the balance of unspecified work not used.

                     This change order final increases the agreement term a total of thirty-two consecutive calendar days.

                     Award of bid to Kamminga was approved by the Board of County Commissioners on March 12, 2019 in the amount of $898,074.50; Change Order No. 1 increased the contract by $145,114.65 and was approved by the Board on April 7, 2020.

 

Contract No. 189-0112-CP(PLU); PID No. 002424A; decreases the contract amount by ($84,965.72) for a revised total amount of $958,223.43.

Summary:

Change Order No. 2 (final) decreases the Board approved expenditure by ($84,965.72) and accepts the contract as complete.  The project was substantially complete on May 20, 2020 and obtained final completion on August 6, 2020.  Liquidated damages do not apply as the County received substantial and beneficial use on May 20, 2020.  Final inspections for all work performed under the contract were conducted by the representatives of the Public Works Construction Management Division. This change order final increases the agreement term thirty-two (32) consecutive calendar days to complete punch list items.

 

Background/Explanation:

The purpose of this contract was to construct two (2) water quality treatment ponds.  The wet pond includes water diverted from McKay Creek to a wet detention pond for water quality treatment.  A steel sheet piling structure (weir) was installed upstream of the existing limestone outcropping to raise the water elevation in McKay Creek during storm events.  The intention stormwater can be diverted to the wet pond for water quality treatment.  The dry pond components consist of a dry retention pond with a stormwater treatment device to separate sediment and nutrients form stormwater runoff prior to entering the dry retention pond.  Both ponds discharge back into McKay Creek.

 

Fiscal Impact:

Original Estimated expenditure not to exceed:         $898,074.50

Increase due to Change Order No. 1:                       $145,114.65

Decrease due to Change Order No. 2 (final):          ($ 84,965.72)

Revised estimated total expenditure:                       $958,223.43
