Approval and execution by the County Administrator of Change Order No. 1 (final) with The Lane Construction Corporation for road shoulder & resurfacing - Keystone Road from East Lake Road to County Line.

 

                     This project consisted of constructing five-foot paved shoulder with safety edge, and mill and resurface the roadway along Keystone Road from East Lake Road to Pinellas/Hillsborough County Line.

                     This change order decreases the contract in the amount of ($55,444.60) based on the difference between estimated and final quantities utilized.

                     The Agreement was extended by four hundred ten (410) consecutive calendar days as part of this change order for a final completion date of September 24, 2019.  (Delay in submittal of the change order related to resolution of a drainage issue and grant close-out with FDOT)

                     The Board of County Commissioners (Board) awarded this contract on June 20, 2017.

 

Contract No. 167-0213-CP(PLU); PID No. 001769A; decreasing the contract amount by ($55,444.60) for a revised total of $2,038,713.16; the revised agreement expiration date is September 24, 2019.

Summary:

Change Order No. 1 (final) decreases the Board approved expenditure by ($55,444.60), accepts the contract as complete and authorizes final payment.  Substantial completion was achieved on November 16, 2018; final completion was accepted on September 24, 2019.  Liquidated damages do not apply as the County received substantial and beneficial use on November 16, 2018, within the original contract duration.

The delay in submittal of this change order from final completion date was due to waiting for resolution of a drainage issue where a mitered end section was proposed to be constructed.  This never occurred due to the cost to tight sheet, de-water/de-muck and backfill the location was deemed cost prohibitive (approximately $150,000.00 for the sheeting alone).  No delay claim was filed by the contractor.  The remainder of the delay was due to resolving issues related to close-out of grant items with Florida Department of Transportation (FDOT) including certified time sheets for the contractor’s sub-consultants.

 

Background/Explanation:

The dual purpose of this project was to construct a five-foot paved road shoulder with safety edge, and mill and resurface the roadway along Keystone Road from east of East Lake Road to the Pinellas/Hillsborough County Line. This project was necessary due to safety concerns for motorists and to provide a safe lane for bicycle travel.

 

Fiscal Impact:

Expenditure not to exceed:                                    $2,094,157.76

Decrease due to Change Order No. 1 (final):       ($     55,444.60)

Final Revised Agreement Amount:                        $2,038,713.16

 

Funding derived from the Local Infrastructure Sales Tax (Penny for Pinellas) and Local Agency Program funding through the FDOT. County funding provided for the cost of milling and resurfacing and the FDOT grant provided for the cost of the shoulder with safety edge.

 

Delegated Authority:

Authority for the County Administrator to approve and execute this change order is granted under Code Section 2-62 (a)(3).
