Approval of the updated Allegiant Air, LLC contract that was previously approved in Granicus item number 19-1297A. Substitute the updated Agreement for the Agreement that was previously approved by the Board of County Commissioners (Board).
• The new five-year Agreement for Fiscal Years 2020 through 2024 was previously approved by the Board on September 24, 2019.
• Due to a scrivener’s error, language in Sections 5.1 (“General”) and Section 5.2 (Fee Waivers) was left out of the last approved agreement. This language is consistent with the prior agreement with Allegiant from 2013.
• The fiscal impact from the Granicus Number 19-1297A remains the same.
• The original terms of the Operating and Use Agreement remain intact and unchanged.

Re-executing the updated Operating and Use Agreement will capture the business deal that was originally negotiated between Allegiant Air, LLC and St. Pete-Clearwater International Airport (PIE).

Background Information:
The Board approved the Allegiant Air, LLC Operating and Use Agreement with PIE on September 24, 2019. The agreement was executed and recorded. The scrivener’s error was not discovered until Allegiant received their executed copy. Allegiant brought it to the attention of the Airport Director. The County Attorney recommended PIE submit the corrected agreement to the Board and have it approved again.
The provisions in sections 5.1 and 5.2 provide specified fee waivers for new non-stop destinations added by Allegiant for two years (or one year if an incumbent airline is providing service to the destination). This is consistent with the prior agreement with Allegiant.
Fiscal Impact:
The fiscal impact remains unchanged as a result of this updated agreement. The estimated revenue and marketing expenditures were estimated in anticipation of this agreement and are still consistent with PIE’s FY20 Adopted Budget.
