Summary:
This Local Agency Program Agreement (LAP) provides up to $474,367.00 of the funding needed for construction and construction engineering inspection activities associated with the 62nd Avenue Sidewalk Improvement Project from 62nd Street North to east of 58th Street North. Total project construction cost including intersection improvement is estimated at $1,884,477.00. Design work has been completed under a related LAP agreement with FDOT. Construction activities will begin upon issuance of a notice to proceed from the FDOT with project completion anticipated within one (1) year.
Background Information:
The purpose of this project is construction of a five-foot sidewalk on the south side of 62nd Avenue North from 62nd Street North to 58th Street North. Additionally, the intersection of 62nd Street North and 58th Street North will be improved, and a new traffic signal will be installed. The project length is approximately 0.63 miles.
Paragraph 15 of the agreement requires the County indemnify FDOT within the limitations of Section 768.28, Florida Statutes, which is in conflict with County Resolution 06-70. Staff has requested and FDOT has responded that the indemnification requirement is standard language and they will not modify their boilerplate. Staff and the County Attorney agree the indemnification requirement is within an acceptable level of risk.
Fiscal Impact:
This project is budgeted in the Capital Improvement Program: Transportation Function, Sidewalk Projects program. The sidewalk project is funded by a federal pass-through grant administered by the FDOT through this LAP agreement. The agreement is consistent with the FY20 Tentative Budget and FY20-25 Capital Improvement Plan. The FDOT is providing $474,367.00 for the cost of construction and construction engineering inspection services. The Local Option Infrastructure Sales Tax (Penny for Pinellas) is intended to provide funding for the related intersection project, although the engineering estimate exceeds the FY20 Tentative Budget and FY20-25 Capital Improvement Plan for the intersection project.
