Adopt the resolution authorizing the late payment of the Local Government Infrastructure Sales Surtax to the beach communities to complete individual portions of the Gulf Boulevard Improvement program (Improvement Plan) pursuant to the substantive terms of the original Interlocal Agreement.

 

                     Extends the duration of the reimbursement period of the original Interlocal Agreement to September 30, 2021.

                     Projects must be consistent with the original Interlocal Agreement Improvement Plan.

                     No change to overall funding amount.

Summary:

Approval of this resolution will allow for the continuation of the reimbursement period to the Beach Communities for the completion of projects associated with the Gulf Boulevard Improvement Plan.  Several of the Beach Communities have not completed their portion of work associated with this project and are not expected to be able to invoice the County and receive reimbursement, pursuant to the terms of the original Interlocal Agreement, prior to September 30, 2019.  Approval of this resolution will allow the County to continue to make payments for amounts invoiced by September 30, 2021.  County staff has been in communication with the members of the Barrier Island Governmental Council (BIG-C) regarding the processing of this resolution.  They have provided their support for approval of the resolution.  

In order to be eligible for reimbursement, projects must be consistent with the original Interlocal Agreement Improvement Plan.  The total allocation to the Beach Communities shall not exceed the amounts defined in the original Interlocal Agreement dated July 10, 2012.

 

Background Information:

The original Interlocal Agreement, approved by the Board of County Commissioners on July 10, 2012, provided funding for an amount not to exceed $35M from the Local Government Infrastructure Sales Surtax (“Penny”), with an agreement expiration date of September 30, 2019.  The agreement also provided for funding allocation to the individual Beach Communities based upon frontage on Gulf Boulevard.  The BIG-C is responsible for determining the eligibility of projects within the Improvement Plan.  The individual Beach Communities are responsible for project design, implementation, and on-going maintenance in perpetuity.

The Interlocal Agreement contains a provision that states, “In the event that a City elects not to complete an Eligible Project on the Improvement Plan, the reimbursable cost of the Eligible Project is less than the sum allocated to a City [by the interlocal], or funds are not otherwise paid to a City prior to the expiration of the term or termination of this Agreement, said funds shall be retained by the County for uses solely within the discretion of the County.”  This resolution is intended to exercise the County’s discretion described in that provision and allow the cities to complete work in progress and still be paid from the allocated Penny funds through September 30, 2021.

 

Fiscal Impact:

This project is funded by the Penny for Pinellas Infrastructure Sales Surtax and is budgeted within the Transportation Function of the Capital Improvement Program.  Budgeted appropriation that is not spent by September 30, 2019 for this project will be carried forward into FY20 and, as necessary, FY21.
