Approval of the proposed Ordinance amending Chapter 2, Article V of the Pinellas County Code (Code) related to purchasing.

 

                     Request approval to modify the Code to reflect the current Small Business Enterprise program.

                     Current Code Section 2-165 does not conform to current case law.

                     The language currently expressed in Code Section 2-165 will be replaced in its entirety with the proposed language.

Summary:

On April 23, 2019, the Board approved the request to advertise a public hearing to modify the Code.  The proposed modification is required as currently Code Section 2-165 does not reflect current case law nor does it reflect the structure or direction of the SBE as approved by the Board.  This Code revision will replace the current language expressed in Code Section 2-165.

 

Background Information:

Code Section 2-165 has been expressed in its current form since the 1980s.  The language contained in Code Section 2-165 does not conform to current case law.  Revision of this section of Code will ensure the County is accurately expressing current operations while also ensuring Code compliance.
