Recommended Action

Consider granting the petition to vacate, and if granted, adopt the attached resolution pursuant to Florida State Statute 177.  Authorize the Clerk of the Court to attest and record the resolution in the public records of Pinellas County.

 

                     The vacation of the portion of the easement will not affect the natural easement area.

                     The minor vacation of the easement will allow more use of the rear yard.

Summary:

The purpose of this request is to vacate a portion of a drainage, utility and/or the natural area easement in the rear of the property.  The petitioner is seeking the vacation to further utilize their backyard.  The area to be vacated is thirteen (13) feet x forty (40) feet.

 

Background Information:

The vacation of the easement would allow the property owner to upgrade an existing screened porch into a sun room by extending the structure out to align with the built out portion of the house.  The petitioner also intends to add a patio outside the sun room.

County departments were queried and have no objection to the vacation request.   

Letters of no objection were received from Bright House, Duke Energy, Frontier, Pinellas County Utilities Engineering, TECO Gas and WOW!

The petition was properly advertised in accordance with Florida State Statute 177.  Pursuant to the Real Property Division Procedures, notice was mailed by the Clerk of the Court to property owners within two hundred feet of the subject property.  The Deputy Clerk will report to the Board any citizen support or opposition.
