Approval and execution by the County Administrator of Amendment No. 2 (Corrective Instrument) to the Agreement with Oracle America, Inc. (Oracle), as requested by the Business Technology Services Department (BTS), for requirements of Software Licenses and Maintenance Support.
Contract No. 090-0173M(RO) effective through January 29, 2020.
• The approval and execution of Amendment No. 2 has no fiscal impact.
• Oracle mistakenly omitted Amendment No. 2; it should have been included with the documents submitted for the extension approved by the Board of County Commissioners (Board) on November 20, 2018.
• Amendment No. 2 extends the executed terms and conditions for two (2) years of the original agreement, but does not obligate the County to renew past the approved twelve (12) month time extension and monetary increase.

Summary:
The approval and execution of Amendment No. 2 allows Oracle America, Inc. to fully complete the latest renewal process with without any anticipated interruption of service or support.
Background/Explanation:
This contract provides for the maintenance and support of Oracle software licenses which are utilized to support many critical business processes including the Oracle Project Unified Solution (OPUS) system.
The contract was originally approved by the Board on January 5, 2010 for a three (3) year period. On March 27, 2012, the Board approved Amendment No.1 which extended the agreement to seven (7) years, and on January 24, 2017, the Board approved an increase to the Agreement. On November 20, 2018, the Board approved an extension and increase of funds.
Fiscal Impact:
Amendment No. 2 has no fiscal impact pertaining to the agreement with Oracle.
Delegated Authority:
Authority for the County Administrator to approve and execute Amendment No. 2 is granted under Code Section 2-188(a).
