Ratify, confirm and enter into the minutes the County Administrator approved First Amendment to the Agreement with DRC Emergency Services, LLC (DRC) for disaster debris collection and removal services specifically related to red tide remediation services.
Additionally, approve the Second Amendment to the Agreement with DRC for continued red tide remediation services.
Contract no. 156-0491-P(JA) increase in the amount of $5,000,000.00 for a revised expenditure in the amount of $6,300,748.70 through completion of red tide remediation. Authorize the Chairman to sign and Clerk of Court to attest.
• The County Administrator approved award of the Debris Collection Contract on August 7, 2017 with seven (7) firms. Ratification of the County Administrator’s approval was approved by the Board of County Commissioners on October 13, 2017.
• The County Administrator approved the First Amendment to the Debris Collection Contract on September 21, 2018 due to the red tide emergency adding pay items and increasing the contract expenditure to accommodate red tide clean up.
• After soliciting fees from firms awarded the Debris Collection Contract staff recommended proceeding with DRC as their fees were lower in price for most pay items.
• Funding for this work is available from the Florida Department of Environmental Protection grant mentioned in the previous item.

Summary:
The Second Amendment to the Agreement requests the addition of pay items for Waste Management bags, dumpster liners and dura-base mats. In addition there is an increase in the amount of $5,000,000.00 to the original approved amount of $1,300,748.70 to provide for continued red tide remediation.
Background Information:
As provided by County code, the County Administrator approved the First Amendment to the Debris Collection Contract on September 21, 2018 due to the red tide emergency adding pay items and increasing the contract expenditure.
The County Administrator approved award of the Debris Collection Contract on August 7, 2017 with seven (7) firms. Ratification of the County Administrator’s approval was approved by the Board of County Commissioners on October 13, 2017.
After soliciting fees from firms awarded the Debris Collection Contract staff recommended proceeding with DRC as their fees were lower in price for most pay items.
During August 2018, the Governor issued Executive Order 18-221 declaring a state of emergency due to impacts of red tide in Collier, Lee, Charlotte, Sarasota, Manatee, Hillsborough, and Pinellas counties. Through the executive order, state funding is available to respond to red tide impacts in southwest Florida and the Tampa Bay area. The County continues to see varying concentration levels of red tide resulting in significant impacts to marine life. Based on the best available information, red tide may continue to cause significant impacts to the County and therefore an increase in a funding assistance grant has been requested to cover the expenses associated with contractual services to remove and dispose of red tide related debris. The County will continue to be the recipient of the funds from the Florida Department Environmental Protection (FDEP) and will perform any clean up requested by the other municipalities. The County has received $3,300,748.70 from the FDEP and will be authorized to receive an additional $3 million through Amendment 2, a companion item on the Board of County Commissioners agenda for November 20, 2018. In the event additional resources are needed, the FDEP has indicated they can amend the agreement to add additional funding.
