Local Agency Program (LAP) Agreement, and accompanying Resolution with the Florida Department of Transportation (FDOT) for the County Road (CR) 694 (Park Boulevard) sidewalk improvement project, from Starkey Road to 66th Street North.  Chairman to sign and the Clerk of the Circuit Court to attest the Agreement.

FDOT FPN: 424564 4 58/68 01, County PID No. 001512A, providing $1,509,918.00 in construction grant funding.

Summary:

Approval of this grant will provide one hundred percent (100%) of the funding necessary to pay for construction activities, as well as construction engineering inspection (CEI) services, for the CR 694 (Park Boulevard) sidewalk improvement project, from Starkey Road to 66th Street North.

 

Background Information:

This project provides for construction of Americans with Disabilities Act (A.D.A.) compliant concrete sidewalk, curb ramps and driveways on both sides of CR 694 (Park Boulevard) from Starkey Road to 66th Street North.   The project primarily focuses on improving and upgrading the existing sidewalk in order to be compliant with the A.D.A. through modification to existing driveways where they intersect with the existing sidewalks, upgrades to the existing pedestrian curb ramps at side streets, and replacement of broken or deficient sidewalk along the corridor.  In addition, the project will include upgrading the existing mid-block pedestrian crossing at 79th Street North (adjacent to the Wagon Wheel Flea Market) to a full pedestrian signal, improving pedestrian accessibility on 74th Avenue North (Frontage Road) by upgrading the existing sidewalk and adding designated parking lanes, as well as upgrading the existing pedestrian signals where Park Boulevard intersects with 83rd Street North and Belcher Road.

The FDOT also provided design funding for this project.  Design activities are complete, and the project will be entering the bid phase upon full execution of this Agreement and issuance of a notice to proceed from FDOT.  Right-of-way requirements and right-of-way certification have been completed by the County and accepted by FDOT as part of the design process.  Construction activities are anticipated to commence in the spring of 2019, and expected to be completed by early 2020.  This Agreement is effective through July 28, 2020.

Additionally, Section 15 of the Agreement contains indemnification language that is not in accordance with County Resolution No. 06-70.  County staff has requested, and FDOT has denied revising their boilerplate requirements.  County staff and the County Attorney’s Office agree that the requirement is within an acceptable level of risk.
 

 

Fiscal Impact:

Funding for this project is budgeted in the Capital Improvement Program: Transportation and Traffic Flow, Sidewalk Projects program allocation.  The source of funding is provided by a federal pass-through grant administered by the FDOT through this LAP Agreement.  The LAP Agreement is providing up to $1,509,918.00, or one hundred (100%) of the funding necessary to complete construction of this project on a reimbursement basis. This Agreement is consistent with the FY19 Tentative Budget and FY19-24 Capital Improvement Plan.
