Summary:

This action is the result of the Marcineks’ construction of an observation pier.  This pier is non-compliant with the permit issued in 2014, and erected on a County right-of-way.  The pier owner and the pier contractor were afforded an opportunity to come into compliance but have failed to do so.  This suit would seek the injunctive relief of the offending pier being removed from the County’s right-of-way.

This approval includes bringing suit against all defendants that may be or become necessary to fully litigate this action.
