Summary:
The petitioner is seeking a 2.2’ x 63.5’ vacation of a ten (10) foot utility easement. The purpose for the vacation request is to clear a building encroachment into a utility easement.
Background Information:
The home was built in 1980, with the western side of the slab foundation encroaching two point two (2.2) feet into the utility easement. This vacation request is necessary for the petitioners to obtain clear title. County departments were queried and have no objection to the vacation of the easement.
Letters of no objection were received from Bright House, Duke Energy, Frontier, Pinellas County Utilities Engineering, TECO Electric, TECO Gas and WOW!
The petition was properly advertised in accordance with Florida State Statute 177.101. Pursuant to the Real Property Division Procedures, notice was mailed by the Clerk of the Court to property owners within three hundred feet of the subject property. The Deputy Clerk will report to the Board any citizen support or opposition.
