Consider granting the petition to vacate, and if granted, adopt the attached resolution pursuant to Florida State Statute 177 and authorize the Clerk to attest and record the resolution in the public records of Pinellas County.

Summary:

The purpose of this petition to vacate request is to clear a building encroachment into a drainage easement caused by the installation of an aluminum screened Florida room.  The petitioner is seeking a four and one-half (4.5) foot vacation of the drainage easement. 

 

Background Information:

There is a thirty (30) foot drainage easement, by plat, across the rear of the petitioner’s property. A large drainage pipe is located within the easement which conveys storm water through a public drainage system. A portion of this screened room encroaches into the easement.  In 2002, the County issued a building permit for construction of the aluminum screened Florida room, with a twenty-five (25) foot setback.
 
County departments were queried and have no objection to the vacation of the easement.   

Letters of no objection were received from Bright House, Duke Energy, Frontier, Pinellas County Utilities Engineering, TECO Electric, TECO Gas and WOW!

The petition was properly advertised in accordance with Florida State Statute 177.101.  Pursuant to the Real Property Division Procedures, notice was mailed by the Clerk of the Court to property owners within two hundred feet of the subject property.  The Deputy Clerk will report to the Board any citizen support or opposition.
