Recommended Action

Approval of the road transfer interlocal agreement with the City of Oldsmar (City) for the transfer of the following roadway segments:

St. Clair Avenue from SR 580 to Meriden Avenue, Meriden Avenue from Shore Boulevard to Duane Avenue, Shore Boulevard from the CSXT Railroad right-of-way to 5 feet east of the northerly extension of the east line on Lot 1, Block 20 of subdivision, and Duane Avenue from the CSXT Railroad right-of-way to Meriden Avenue.

Authorize the Chairman to sign and the Clerk to attest the agreement; authorize the Clerk to record the corresponding right-of-way map in the official public records of the County.

Summary:

This agreement provides for the transfer of jurisdiction and associated maintenance responsibilities for the above County roadway segments to the City upon official filing with the Clerk of the Circuit Court.

 

Background Information:

The Department of Public Works has been partnering with County municipalities to better define right-of-way maintenance responsibilities in areas where jurisdictional boundaries are shared. The attached roadway agreement serves to transfer jurisdictional responsibility for designated public road segments that are within, or partially within, the City’s municipal limits.

Both the County and the City agree that it is in the best interest of the parties that responsibilities associated with the operation, maintenance, planning, design, and construction of the identified road segments, along with any future improvements thereto, be transferred to the City.

The City accepts all legal rights of the roadway segments that are within, and appurtenant to, the rights-of-way being transferred. The City agrees to allow the County, through a permanent permit, to utilize rights-of-way associated with the transferred roadway segments for County owned utilities.

 

Fiscal Impact:

There is no cost to the County for entering into this agreement with the City; however, an overall reduction to future maintenance costs will be realized.
