Recommended Action

Approval of the cooperative funding agreement with the Southwest Florida Water Management District (SWFWMD) for the Roosevelt Creek Stormwater Facility Improvements, and authorize the Chairman to execute and the Clerk to attest the agreement.

SWFWMD Agreement No. 18CF0000947, County PID No. 000296A/003130A, SWFWMD Funding Amount $350,510.00.

Summary:

The purpose of this agreement is to provide cooperative funding assistance for the Roosevelt Creek project in order to improve water quality.

 

Background Information:

This project is consistent with the Surface Water Improvement and Management (SWIM) Plan for Tampa Bay, a SWIM priority water body, which outlines goals to restore habitat and reduce pollutant loads entering Tampa Bay.

The project includes design, permitting and construction of stormwater treatment Best Management Practices (BMPs) in the Roosevelt Basin which drains to Old Tampa Bay.  The retrofit proposes to increase the watershed to include an area not currently receiving stormwater treatment and improve nitrogen removal in the existing pond.  The drainage area includes approximately 21 acres of urban development.  The location of project is within the City of Pinellas Park; however, this is a County-owned property and contains an existing County-permitted facility.

The contract period is from October 1, 2017 through July 1, 2021.  The project is currently in the 30% conceptual design phase.  Construction is anticipated to begin in May 2019 for a duration of approximately one (1) year.

Finally, section 10 of this agreement requires the County to indemnify and hold harmless SWFWMD to the extent permitted by law, as limited by and pursuant to the provisions of Section 768.28, Florida Statutes.  County Resolution No. 06-70 prohibits the County from indemnifying others under most circumstances.  SWFWMD will not modify the indemnification section of this agreement as it is a standard requirement in their agreements.  Staff and the County Attorney agree that the indemnification requirement is within an acceptable level of risk.

 

Fiscal Impact:

Funding for this project is budgeted in the Capital Improvement Program: Physical Environment, Regional Stormwater Quality Improvements program allocation. The sources of funding are $350,510.00 from the Local Infrastructure Sales Tax (Penny for Pinellas), $350,510.00 in grant funding from SWFWMD, with total project costs estimated at $701,020.00.
