Summary:
On October 31, 2017, the Board of County Commissioners (Board) terminated, for cause, The Artec Group, Inc.’s right to proceed under the contract for Terminal Improvements - Phase 3, Gates 7-10 Terminal Addition (PID #001544A). Outside counsel familiar with complex construction litigation recommended that Pinellas County file suit as soon as possible for strategic reasons. Through litigation, the County would seek to recoup some, if not all, of the monies lost due to The Artec Group, Inc.’s failure to complete the project in accordance with the contract documents. The surety or other necessary parties may be brought into the litigation as needed to protect the County’s interests.
Background Information:
Due to the delay between the October 31, 2017 Board meeting wherein the Contractor’s right to proceed was terminated and this Board meeting, the Chair authorized the initiation of litigation subject to subsequent Board ratification.
