Summary:

The Pinellas County Council for Persons with Disabilities (PCCPD) serves as an advisory board, as well as medium of communication between the Board of County Commissioners (Board) and the community, to address issues and concerns of interest from the community of persons with disabilities.

 

Background Information:

A waiver of ethical conflict is available under Florida law when an appointee serving on a board, such as the PCCPD, is simultaneously employed by an entity which is conducting business with the agency.  In this instance, the PCCPD is comprised of seven (7) appointees by the Board, and six (6) appointees from organizations, which collectively represent and advocate for persons with disabilities throughout the County.  One of the organizational appointing authorities to the PCCPD is Boley Centers, Inc. (Boley Centers).  Boley Centers provides housing development and consulting services to the County through contractual relationships they have with Human Services.  Boley Centers has appointed Mr. Jack Humburg as their appointee to the PCCPD, and requests the Board consider waiving the potential ethical conflict which may occur due to his position with the agency.

As provided in Fla. Stat. subsection 112.31.(12), an ethical conflict can be waived by a two-thirds (2/3) vote of the Board.  If granted, the waiver will allow Mr. Humburg to serve on the PCCPD and continue his employment with Boley Centers.  Moreover, at such time as any matter concerning Boley Centers may come before the PCCPD, Mr. Humburg would be required to announce his conflict and abstain from voting.  If this occurs, he would also have to file Form 8(b) Memorandum of Voting Conflict for Public Officer, with the PCCPD.
