Approval and execution by the County Administrator of a Corrective Perpetual Easement (Easement) in favor of the Florida Department of Transportation (FDOT).

Summary:

This Easement is a correction of the easement recorded in Official Record 19436, Page1892, dated December 6, 2016, between the County and the FDOT for the Gateway Expressway Project. In addition to drainage, the Easement will allow FDOT to use the easement area for sidewalks and related roadway appertanances.

 

Background/Explanation:

The Board of County Commissioner’s approved the Local Funding Interlocal Agreement (LFA) for the Gateway Expressway Project on August 9, 2016.  The perpetual easement for Parcel 800.01 was included in the LFA and recorded in Official Record 19436, Page1892, dated December 6, 2016.  The recorded document is limited to a perpetual easement for the purpose of constructing and maintaining a drainage easement.  However, FDOT’s design build contractor wanted more flexibility within the easement area including construction of a sidewalk.  To resolve the issue, FDOT is proposing to amend Parcel 800.01.  The proposed Easement is for the purpose of constructing drainage structures, sidewalks, and related roadway appurtenances, over, under, upon and through the easement area.
