Approval and execution by the County Administrator of two (2) Subordination of County Utility Interest Agreements with the State of Florida Department of Transportation (FDOT).

Summary:

This action allows for certain easement rights now owned by the County to be subordinated to the rights of FDOT.  The subordination of interests are in support of the Board of County Commissioner’s approval of the Local Funding Interlocal Agreement (LFA) for the Gateway Expressway Project on August 9, 2016.  The LFA included acquisition of parcels owned by the County, resulting in a need to subordinate the easement rights of those parcels to the FDOT.

 

Background/Explanation:

The subordination of the County’s interest includes the interest created by the documents (Official Records Book /Page) which are listed in each of the attached Subordination of County Utility Interests documents.

The parcels are located at the northwest corner of 118th Avenue North and 49th Street North.  A portion of the land encumbered by the easements is required by the FDOT for public transportation purposes which is in the public or community interest and for public welfare.

Delegated Authority:

Authority for the County Administrator to sign the Subordination of County Utility Interests Agreements is granted under Code Section 2-62(a)(6).
