Consider granting the petition to vacate, and if granted, adopt the attached resolution pursuant to Florida State Statute 336, and authorize the Clerk to attest and record the resolution in the public records of Pinellas County.

Summary:

The subject petition seeks to vacate a portion of a 100’ right-of-way (ROW) known as Beach Parkway which lies south of the east 20 feet of lot 37, south of all of lots 38 and 39 and that part of a strip of land lying between the southerly extension of the east line of lot 39 and the west lines of lot 40, less and except the east 39 feet as shown on the plat of Harbor View #1, as recorded in Plat Book 6, Page 4 in the public records of Pinellas County.  A sketch is attached to the file.

The petitioner is seeking to vacate a portion of this ROW to better accommodate potential construction on their property.

 

Background Information:

County departments were queried and have no objection to the proposed vacation.

Letters of no objection were received from Bright House, Duke Energy, Verizon, TECO Electric and WOW!.

The petition was properly advertised in accordance with Florida State Statute 336.  Pursuant to the Real Property Division Procedures, notice was mailed by the Clerk of the Court to property owners within two hundred feet of the subject property and three yard signs were installed, two on the subject property and one north of the subject property.  The Deputy Clerk will report to the Board any citizen support or opposition.
