Summary:

Approval of the consent order will resolve asbestos air quality violations.  The Respondent has agreed to the terms outlined in the attached consent order, including a penalty of $33,500.00 to be paid into the Pinellas County Air Pollution Recovery Trust Fund.

 

Background/Explanation:

The Air Quality Division is recognized by the Environmental Protection Agency (EPA) and State of Florida Department of Environmental Protection as a local program and has authority to administer and enforce Federal Asbestos Regulations through program delegation.

 

On June 22, 2016, Air Quality Division (AQD) personnel conducted a surveillance inspection after observing evidence of ongoing renovation activities at the property located at 5111 66th Street North, St. Petersburg, Florida. The on-site inspection by staff and after-the-fact analysis on the suspect material confirmed large quantities of regulated asbestos-containing materials were disturbed in Building 3 during the renovation. No survey for asbestos was performed prior to renovation. The Respondent will pay the penalty of $33,500.00 in three installments as follows: the first payment of $11,166.67 on or before October 3, 2016, the second payment of $11,166.67 on or before November 3, 2016 and the third payment of $11,166.66 on or before December 5, 2016.

 

Fiscal Impact:

$33,500.00 will be deposited into the Pinellas County Air Quality Pollution Recovery Trust Fund pursuant to the schedule in the attached Consent Order.
